Usually I'm not on the bro side of this issue, but California's new law may go a bit too far. It seems to define any sex with someone who is drunk as non-consenual, that, is IMO a step too far.

Silence or lack of resistance does not constitute consent. The legislation says it's also not consent if the person is drunk, drugged, unconscious or asleep.
